Policy ACF, Sexual Misconduct and Sexual Harassment of Students
On September 25, 2025, the Montgomery County Board of Education adopted technical amendments to Board Policy ACF, Sexual Misconduct and Sex-based Harassment of Students, that were needed to comply with federal law. The technical amendments included the title to Policy ACF, Sexual Misconduct and Sexual Harassment of Students, to comply with federal law.
Policy FAA, Educational Facilities Planning
On September 25, 2025, the Montgomery County Board of Education adopted technical amendments to Board Policy FAA, Educational Facilities Planning, to adjust the definition of “Key Facilities Indicators” to “Facilities Condition Index” to quantify the life and value of a facility’s primary building systems as a part of evaluating a building’s overall condition.
Regulation IFD-RA, Curriculum Transparency and Requests to be Excused from Instruction
On August 21, 2025, the Montgomery County Public Schools (MCPS) Regulation IFD-RA, Curriculum Transparency and Requests to be Excused from Instruction, was developed to (i) identify and ensure ongoing notification of core instructional materials used in the classroom, (ii) permit parents and guardians to review core instructional materials upon request, (iii) allow parents and guardians to identify specific core instructional materials that substantially interfere with a sincerely held religious belief and request that their child be excused from any portion of instruction involving that material, and (iv) ensure alternative instructional materials or assignments are provided in a non-punitive manner for any student whose parent/guardian’s request is approved.
Regulation IJA-RC, Non-MCPS Providers of Supporting Services to Students
On October 6, 2025, Montgomery County Public Schools (MCPS) Regulation IJA-RC, Non-MCPS Providers of Supporting Services to Students, was developed at the request of the Division of Specialized Support Services to set forth implementing procedures to promote student access to supporting services in alignment with Montgomery County Board of Education Policy IJA, Social-emotional and Mental Health Programming and Services for Students, and Board Policy COA, Student Well-being and School Safety. The regulation sets forth procedures for establishing partnerships with external health care and social-emotional/mental health providers and the limited circumstances under which parents/guardians may request a private practitioner in MCPS, in person or virtually.
Regulation COC-RA, Trespassing or Willful Disturbance on MCPS Property
On September 9, 2025, revisions to Montgomery County Public Schools Regulation COC-RA, Trespassing or Willful Disturbance on MCPS Property, were approved. Developed by the Division of School Leadership and Improvement in response to principals' requests for clarification on recess procedures in the MCPS Student Code of Conduct, the revised regulation clarifies that assisting another person to trespass or cause a willful disturbance may result in disciplinary action. A technical update to the definition of MCPS property includes vehicles hired by MCPS. The new definition of MCPS property reads: "MCPS property means any school or other MCPS facility, including grounds owned or operated by MCPS; buses and other vehicles owned, operated, or hired by MCPS; and the facility and/or grounds of any MCPS-sponsored activity." Further updates to directory information reflect changes in the MCPS organizational structure.
Regulation GHA-RA, Maintenance of the Position Classification Plan
On September 9, 2025, revisions to Montgomery County Public Schools (MCPS) Regulation GHA-RA, Maintenance of the Position Classification Plan, were approved. Developed at the request of the Division of Human Resources and Talent Management, in consultation with the Montgomery County Association of Administrators and Principals (MCAAP)/Montgomery County Business and Operations Administrators (MCBOA), the revised regulation updates current practices for the maintenance of the employee position classification system and include relevant provisions of MCPS Regulation GFA-RA, Establishment and Abolishment of Positions. Further updates to directory information reflect changes in the MCPS organizational structure.
Regulation GCB-RA, Investigation of Allegations of Employee Misconduct
On October 15, 2025, Montgomery County Public Schools (MCPS) Regulation GCB-RA, Reporting and Handling Fraudulent Actions by MCPS Employees, Agents, or Contractors, was substantially revised to address investigations of all allegations of misconduct of MCPS employees. The regulation has been retitled “Investigation of Allegations of Employee Misconduct” and aligns with Board of Education Policy GCB, Investigation of Allegations of Employee Misconduct, adopted by the Board on March 18, 2025.
Regulation GBB-RA, Employee Assistance Program
On October 13, 2025, Montgomery County Public Schools (MCPS) Regulation GBB-RA, Employee Assistance Program, was revised at the request of the Division of Human Resources and Talent Management to update procedures to reflect the priorities of the Board of Education (Board), as stated in Board of Education Policy GAA, Workforce Excellence.
Regulation FAA-RA, Educational Facilities Planning
On October 8, 2025, revisions to Montgomery County Public Schools Regulation FAA-RA, Educational Facilities Planning, were approved that align with amendments to Board of Education Policy FAA, Educational Facilities Planning, adopted on September 25, 2025. Board-adopted amendments to Board of Education Policy FAA, Educational Facilities Planning, replaced “Key Facilities Indicators” with “Facilities Condition Index” to quantify the life and value of a facility’s primary building systems as a part of evaluating a building’s overall condition. Additional technical revisions updated terminology currently in use, replacing “English for Speakers of Other Languages” programs with “English Language Development” programs, and updated the current title of Board of Education Policy ABA, Community Engagement (formerly “Involvement”).
Regulation ECJ-RA, Animals on MCPS Property
On October 6, 2025, revisions to Montgomery County Public Schools (MCPS) Regulation ECJ-RA, Animals on School Grounds (Attachment), were approved. Revised at the request of the Division of Specialized Support Services (DSSS) and the Division of School Leadership and Improvement, revisions clarify provisions of the Americans with Disabilities Act that relate to non-service animals on MCPS property and other needed updates. Key aspects of the revised regulation include the following: Distinctions between service animals as compared to emotional support animals or therapy dogs; and provisions for the development of Memoranda of Understanding to permit therapy animals, solely at the request of the DSSS.
Regulation IQA-RA, Administration of the High School Interscholastic Athletics Program
On October 6, 2025, revisions to Montgomery County Public Schools (MCPS) Regulation IQA-RA, Administration of the High School Interscholastic Athletics Program (Attachment), were approved. Developed at the request of the Department of Athletics and the Division of Appeals, the revised regulation prohibits students and employees or contractors from exerting undue influence on the competitive advantage of any MCPS high school’s interscholastic athletic program through misuse of the student transfer or nonresident tuition enrollment procedures. Additional revisions to clarify the relationship between, and the governance authority of, the state level Maryland Public Secondary Schools Athletic Association (MPSSAA) as distinguished from the Montgomery County Public Secondary Schools Athletic Association (MCPSSAA), with additional clarification of appeal procedures.
Regulation GFA-RA, Establishment and Abolishment of Positions
On September 23, 2025, Regulation GFA-RA, Establishment and Abolishment of Positions, was rescinded following substantial revision of MCPS Regulation GHA-RA, Position Classification Maintenance, in response to concerns expressed by the Montgomery County Board of Education members and the Division of Human Resources and Talent Management.
Regulation GBE-RA, Employee Recognition
On October 7, 2025, Montgomery County Public Schools (MCPS) Regulation GBE-RA, Employee Recognition, was rescinded. Developed in 1982 to recognize years of service, exceptional acts, and outstanding service, employee recognition has now been elevated in the Montgomery County Board of Education Policy GAA, Workforce Excellence, as amended on March 18, 2025. Implementation strategies set forth in the Board of Education Policy GAA, Workforce Excellence, direct the superintendent of schools to recognize distinguished employee service to public education or outstanding contributions to MCPS, by either individual employees or groups of employees, that directly or indirectly prepares all students to thrive. The regulation has been identified by the Division of Human Resources and Talent Management for rescission as redundant with Board of Education Policy GAA, Workforce Excellence.
Regulation GEG-RA, Affirmative Action
On October 7, 2025, Montgomery County Public Schools (MCPS) Regulation GEG-RA, Affirmative Action, was rescinded. Developed in 1988, procedures no longer align with federal law. Legally permissible efforts to encourage applicants for job openings were elevated in the Montgomery County Board of Education Policy GAA, Workforce Excellence, amended on March 18, 2025. The Division of Human Resources and Talent Management and the Division of Legal Services recommend MCPS Regulation GEG-RA, Affirmative Action, for rescission as it no longer complies with federal law.
Regulation GBA-RA, Equal Employment Opportunity
On October 7, 2025, Regulation GBA-RA, Equal Employment Opportunity, was rescinded. Developed in 1979 to establish procedures in the event of an alleged violation of the laws governing employment opportunity, the regulation was recommended for rescission by the Division of Human Resources and Talent Management and the Division of Legal Services because it is redundant with Policy ACA and Regulation ACA-RA, which are more current. Last revised in 2017, nondiscrimination and equity are elevated in Montgomery County Board of Education Policy ACA, Nondiscrimination, Equity, and Cultural Proficiency, procedures for pursuing an employment discrimination complaint are addressed in Regulation ACA-RA, Nondiscrimination, Equity, and Cultural Proficiency.
